The Rights and Duties of envoy as in the law (112) for the year 1995 about the organization of missions, study holiday and scholarship affairs

1)    The decree No 23:

     The member of mission should be dispatched in the determined period, should attend the study or exercise regularly, have a good reputation, maintain the reputation of his country and respect the traditions of countries where he will go.

2)    The decree No 24:

     The executive committee has the right to decide exceptionally to extend the mission after assuring that the member has studied satisfactorily.

3)    The decree No 25:

      It is not allowed for the member of mission, scholarship or delegated employee in study holiday to marry from the foreigners.

    

4)    The decree No 26:

     It is not allowed for the member of mission, scholarship or study holiday to work for profit through the mission period except if this work relates to the mission topic and does not affect the study, do it is allowed for the head of executive committee, after the approval of the mission office director or the supervisor and the delegation institution, to make him/her work, but they will take form his/her salary a half of what he gains from this work.

 

5)    The decree No 27:

     It is not allowed to change the kind of mission or its Curriculum except if the executive mission and the delegation institution approved and also the study holiday and scholarship.

6)    The decree No 28:

    The executive mission, after taking the opinion of the delegation institution, has the right to finish the member mission as the reports indicates that he/she can not achieve the intended purpose of the mission and the member has the right to complain against this decision through 15 days since the date he was notified by telegram and present a request for the head of high mission committee to see this complain and this is also for the members of study holidays and scholarships.

7)    The decree No 29:

      It is not allowed for the member of mission or study holiday or scholarship to leave the institution or change the institution or the delegation institution except after the approval of mission office manager and the member whom his/her mission is not less than three years can return to his home once to spend the holiday, but he/she should spend at least two years in the mission.

8)    The decree No 30:

     The member of mission, study holiday or scholarship should return to his/her home through a month since he/she finished his/her study, but if he/she does not return, his/her salary will be stopped without prejudice to the laws and schedules (provisions and penalties).

9)    The decree No 31:

     The member of mission, study holiday or scholarship is adhered to service the delegation institution or any governmental authority where the institution wants him to go with the agreement with the executive mission committee for two years, for each year he/she spent in the mission or holiday and the maximum is seven years for the member of mission and five years for the member of study holiday except if the terms of mission or study holiday contains other rules. It is allowed for the higher mission committee to be released if a national necessary or to work in nongovernmental authority.

10)  The decree No 32:

     The member of mission, study holiday or scholarship should go to the mission management through a week since he/he returns as if he/she is an employee, he/she will be sent to the delegation of mission, holiday or scholarship, but if he/she is not an employee, this authority will appoint him in a job through three months since his return and these institutions should list memorial degrees for  its members during study. In all cases, the member will be paid a salary since his/her return from the mission management.

 

11)  The decree No 33:

      The executive committee has the right to end the mission or holiday or scholarship of the members if he/she violates the provisions of one of theses decrees (23, 25, 27, 29 and 30) and ask the member the expenses of mission or salaries that he/she is paid in the holiday or scholarship if he/she violates the decrees (25 and 31).

12)  The decree No 34:

        Every member of mission or scholarship will not go to mission or postpone the procedures in the determined period for unacceptable reasons; he will be deprived of it and of nomination for any mission or scholarship for not less than three years since the date of deprivation.

 

 

13)  The decree No 35:

   The member of mission, study holiday or foreign or international scholarship presents a sponsor that will commit to his responsibility to repay the expenses and salaries of the decree No33 by writing, but if he/she is minor, the guardian will commit by writing to repay this by his/her responsibility. The ministry, in this case, has the right to present an accepted sponsor.

 

14)  The decree No 37:

The period which he/she will spend in the mission, study holiday or scholarship inside Egypt or abroad will be accounted within his/her service and the priority is for the oldest in the case of promotion and in the case of increment  and is accounted in compensation  (retiring) or award. Moreover, the deduction will be taken from the salary.
